"Customer", "you" and "your" refer to any person or business purchasing products from our webshop.
2. Scope of These Terms
These Terms apply to all offers, orders, purchases and agreements made through the Casa Lureto webshop, unless expressly agreed otherwise in writing.
If you are a consumer, nothing in these Terms is intended to limit any mandatory rights you have under applicable consumer protection laws.
If a provision of these Terms conflicts with mandatory applicable law, the mandatory legal provision will prevail.
3. Products and Product Information
We make every reasonable effort to ensure that product descriptions, photographs, specifications, prices and other information on our webshop are accurate and up to date.
However, colours and appearances may vary slightly depending on your screen, device, lighting conditions or other technical factors.
We reserve the right to correct errors, inaccuracies or omissions and to update product information at any time.
Any specific product conditions, instructions or warnings displayed on a product page form part of the information applicable to that product.
4. Prices
All prices displayed to consumers are stated in accordance with applicable law and include applicable VAT where required.
Any applicable shipping costs, additional charges or other costs will be communicated during the ordering process before you complete your purchase.
For international orders, additional taxes, customs duties, import fees or other charges may apply depending on the destination country. Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer.
We reserve the right to correct obvious pricing errors. If an obvious pricing error has occurred and you have placed an order at an incorrect price, we may cancel the order and refund any amount already paid.
5. Orders and Formation of the Agreement
You can place an order through our webshop by following the ordering process and completing the payment process.
Before submitting your order, you will have the opportunity to review and correct your order details.
After placing an order, you will receive an order confirmation by email.
An order confirmation confirms that we have received your order. The purchase agreement is concluded in accordance with the applicable law and the ordering process presented on our webshop.
We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including but not limited to:
-
the product is unavailable;
-
there is an obvious error in the product information or price;
-
we reasonably suspect fraudulent or unlawful activity;
-
delivery to the requested destination is not possible; or
-
fulfilling the order would violate applicable laws or regulations.
If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order.
6. Payment
Payment must be made using one of the payment methods available during checkout.
Your order may be processed only after payment has been successfully authorised or received, where applicable.
If a payment is reversed, declined or otherwise not completed, we may suspend or cancel the order.
7. Availability and Stock
We make reasonable efforts to keep our stock information accurate. However, products may occasionally become unavailable due to unexpected demand, inventory discrepancies or other circumstances.
If a product you ordered becomes unavailable, we will inform you as soon as reasonably possible and, where applicable, offer an appropriate solution or refund.
8. Delivery and Shipping
We deliver to the countries and destinations available for selection during checkout.
Estimated delivery times are communicated on the webshop, during checkout or in your order confirmation.
Unless a different delivery period has been agreed, applicable consumer law may require delivery within the statutory period.
We are not responsible for delays caused by circumstances outside our reasonable control, such as customs procedures, carrier delays, strikes, natural disasters or other force majeure events. This does not affect any mandatory consumer rights you may have.
For international deliveries, the customer is responsible for providing accurate delivery information and, where applicable, complying with local customs and import requirements.
Once an order has been shipped, tracking information may be provided where available.
For consumer purchases, the risk of loss or damage to the products generally remains with us until the products are received by you or by a person designated by you, unless applicable law provides otherwise.
9. Right of Withdrawal
If you are a consumer in the European Union or another jurisdiction where a statutory right of withdrawal applies, you generally have the right to withdraw from an online purchase without giving a reason within the applicable statutory withdrawal period.
For EU consumer purchases of goods, the standard withdrawal period is generally 14 days from the day on which you, or a third party designated by you, receives the goods.
You may exercise your right of withdrawal by clearly informing us of your decision to withdraw from the agreement.
You can contact us at:
Email: info@casa-lureto.com
You may also use the online withdrawal function provided on our website where applicable.
You do not have to provide a reason for exercising your statutory right of withdrawal.
10. How to Return a Product
After informing us that you wish to withdraw from your purchase, you must return the applicable product within the period required by applicable law.
Unless we have offered to collect the product or applicable law requires otherwise, you are responsible for the direct cost of returning the product when exercising the statutory right of withdrawal, provided that we informed you of this obligation before your purchase.
Products should be returned with reasonable care.
You may handle and inspect a product to the extent necessary to establish its nature, characteristics and functioning, as you would normally be able to do in a physical shop. If the product has been handled beyond what is necessary and this results in a loss of value, you may be liable for that diminished value to the extent permitted by applicable law.
11. Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply in all circumstances.
Depending on the nature of the product or service, exceptions may apply under applicable law. These may include, for example:
-
products made according to the customer's specifications or clearly personalised;
-
goods that deteriorate or expire rapidly;
-
sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
-
sealed audio or video recordings or sealed computer software where the seal has been broken;
-
digital content not supplied on a tangible medium where performance has begun with the customer's prior express consent and acknowledgement that the right of withdrawal is lost; and
-
other products or services for which a statutory exception applies.
Where an exception applies, this will be communicated to you before or during the purchase where required by law.
12. Refunds
If you validly exercise your statutory right of withdrawal, we will refund payments received from you in accordance with applicable law.
Unless applicable law provides otherwise, the refund will include the standard delivery cost paid for the original shipment. We are not required to refund additional costs resulting from your choice of a more expensive delivery option than the least expensive standard delivery option we offered.
We may withhold the refund until we have received the returned goods or you have provided evidence that you have sent the goods back, whichever occurs first, where permitted by applicable law.
Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed.
13. Faulty, Damaged or Incorrect Products
If you receive a product that is damaged, defective, incomplete, incorrect or does not conform to the agreement, please contact us as soon as
